Prior to 1968, most adults in the United States could purchase a firearm without state interference. Guns were available in local retail stores, as well as mail-order catalogs, and as long as you hadn’t been convicted of a felony and you had the funds, there weren’t any questions asked.
Things are different now. Depending on where in America you are and what type of gun you want to buy, there’s a good chance you’ll need to pass a NICS-mandated background check to complete your purchase.
Although many people hold a strong opinion for and against gun background checks, they’ve proven to be an integral part of the state's gun control apparatus – and they don’t appear to be leaving anytime soon.
Since background checks are such a requirement for today’s gun enthusiasts, it’s important for gun owners (and those who may someday be gun owners) to understand everything they can, including how the current system works and how it came to be.

The History of Gun Background Checks in the U.S.

The history of background checks for gun purchases reaches back to the first restrictions placed on individuals trying to purchase firearms. Here in the U.S., this occured after the Civil War, when several southern states adopted “Black Codes,” which replaced the prior slave codes and worked to suppress the freedoms of black Americans. Among other restrictions, the Black Codes forbade African-Americans from owning firearms.
The Federal Firearms Act of 1938 began restricting the sales of firearms, requiring those in the business of selling firearms to purchase a Federal Firearms License (FFL) and maintain a list of persons who purchased firearms, including their name and address. The Firearms Act of 1938 also listed convicted felons as the first prohibited persons – who are not allowed, by law, to own, purchase, or possess firearms.
And then something happened that would forever change American history. Six days before Thanksgiving, on November 22, 1963, President John F. Kennedy was assassinated by Lee Harvey Oswald in Dallas using a Mannlicher-Carcano rifle that was chambered in 6.5x52mm Carcano and fitted with a telescopic sight, which he'd purchased from a mail-order catalog.
The 1963 Kennedy assassination was followed by additional high-profile assassinations over the next 5 years:
February 21st, 1965: Malcolm X was assassinated by three members of the Nation of Islam who bull-rushed him on-stage during a speech in Harlem with a 12-gauge sawed-off shotgun and handguns chambered in .45 ACP and 9mm. X had publicly broken away from the Nation of Islam and was openly critical of its leader, Elijah Muhammad.
April 4th, 1968: Martin Luther King Jr. was assassinated by escaped convict James Earl Ray using a .30-06 caliber rifle in Memphis. The prior year Ray had broken out of the Missouri State Penitentiary by hiding in a bread delivery truck. Ray was a notorious escape artist and career criminal who used an alias when purchasing the rifle.
(After the assassination, investigators launched a sixty-five day manhunt for King’s assassin that led them across two continents and four countries which culminated in Ray's arrest at London's Heathrow airport where he was caught traveling on a forged Canadian passport. A decade later in 1979, Ray again broke out of jail - this time escaping from Tennessee’s most notorious maximum security prison, Brushy Mountain State Penitentiary, where he was serving a life sentence for King's assassination.)
June 5th, 1968: Two months after King's assassination in Memphis, Democratic presidential candidate Robert F. Kennedy (JFK's younger brother) was assassinated by Palestinian-born Sirhan Bishara Sirhan in Los Angeles using a revolver chambered in .22. Earlier that day, Kennedy had won the South Dakota and California presidential primaries. Sirhan claimed to be part of an occult organization called the Rosicrucians.
The cumulative effect of these assassinations - along with the emergence of the Black Panthers, who'd started hanging out at government buildings armed to the teeth - led to the Gun Control Act of 1968, which was specifically intended to keep “firearms out of the hands of those not legally entitled to possess them because of age, criminal background, or incompetence.”
Through the Gun Control Act of 1968, the federal government placed restrictions on the sale of firearms across state lines and expanded the prohibited persons who were not allowed to purchase or possess firearms. Under the new law, gun purchases became illegal for those who were:
  • Convicted of a non-business-related felony
  • Found to be mentally incompetent
  • Users of illegal substances
To determine this information, those who wished to purchase a firearm from an FFL had to complete a questionnaire of yes/no questions such as “Are you a convicted felon?” and “Are you a fugitive from justice?” Although these questions needed to be answered, they did not require verification from the gun seller.
In 1972, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) was formed as a way to help control the illegal sales and use of firearms.
In March of 1981, the assassination attempt of President Ronald Reagan led to further gun legislation with the Brady Handgun Violence Prevention Act of 1993, which amended the Gun Control Act of 1968 to now require background checks for the purchase of firearms from a retailer. The Brady Act, as it’s known today, also led to the development of the National Instant Criminal Background Check System (NICS), which launched in 1998, and is the current law on background checks for gun purchases in the U.S.

The National Instant Criminal Background Check System

The National Instant Criminal Background Check System (NICS) was mandated by the Brady Handgun Violence Prevention Act of 1993, and was launched by the FBI on November 30, 1998. The NICS is used by FFLs to check the eligibility of those who wish to purchase firearms.
Located at the FBI’s Criminal Justice Information Services Division in Clarksburg, West Virginia, the NICS is currently used by 30 states and five districts, as well as the District of Columbia, to check the backgrounds of those who wish to purchase firearms. Those states that opt not to use the NICS have their own point of contact (POC) to complete background checks.
The NICS applies a person’s identifying characteristics, including name and date of birth, to its own index, as well as the National Crime Information Center (NCIC) database and the Interstate Identification Index. These systems compare the intended purchaser’s demographic information against the national databases to see if they match someone deemed a prohibited person. Prohibited persons include those who are or were:
  • Convicted of a crime punishable by imprisonment for a year or more
  • Fugitives from justice
  • A user of or addicted to a controlled substance
  • Adjudicated as a mental defective or been committed to a mental health institution
  • Illegal aliens
  • Aliens admitted to the U.S. under a nonimmigrant visa
  • Discharged from the U.S. Armed Forces under dishonorable conditions
  • Renounced their citizenship to the U.S.
  • Subject to a court order that restrains their interactions with an intimate partner or child
  • Convicted of domestic violence
Since its conception, NICS has completed over 300 million background checks and has issued more than 1.3 million denials. The NICS is available 17 hours a day, seven days a week, except for Christmas Day.

How Do Background Checks Work?

When you visit a gun store and attempt to purchase a firearm, you must complete a Firearm Transaction Record, or ATF Form 4473 – which requires the intended purchaser’s name, address, and birthdate. The form also requires a government-issued photo ID and asks questions regarding the individual’s appearance, including height and weight.
Once the form’s completed, the gun seller can either call the 1-800 number for NICS or use the online system to run the background check. In over 90 percent of the cases, the results are almost immediate, with the system either approving, delaying, or denying the purchase within minutes.
With an approval, the sale can immediately proceed as planned with you purchasing the firearm. If there is a delay, the NICS and FBI investigate the inquiry over the next three days. If the FFL does not hear anything within that time period or if a determination cannot be made, then the retailer can, but does not have to, continue with the firearm transfer. When this occurs, it’s often referred to as a “default proceed” sale.
When a denial is made, which occurs in only about 2 percent of background checks, the retailer is unable to sell or transfer the firearm to the individual in question. You must submit a request to the NICS to receive the reason for your denial, the most common of which is a history of a felony conviction.
If you believe you were given an erroneous denial, you can appeal the decision by completing a Voluntary Appeal File (VAF), which can be done online or by mailing your request to the FBI. Along with the VAF application, you will also need to be fingerprinted to move forward with the appeal process.

When is a Background Check Needed to Purchase a Gun?

A background check is necessary any time you purchase a gun from a retail provider, which is defined as someone conducting business in the sale of firearms. These sellers must have a Federal Firearms License (FFL) and are legally mandated to complete a background check for every firearm sold to a non-licensed individual.
It doesn’t matter if you purchase the firearm in a brick-and-mortar store, a gun show, online, or through a magazine – if the seller is a retailer provider (i.e. has an FFL), then the background check must occur.

When is a Background Check Not Needed to Purchase a Gun?

Under federal law, any adult can sell a personally owned firearm to another adult in the same state as long as you know, to the best of your ability, that they’re allowed to own a firearm.
Private sellers aren’t required to ask for identification, they don’t have to complete any forms, nor keep any records of the transaction. What’s more, federal law does not mandate a background check to purchase a firearm from a private seller. This includes buying a gun from a relative, a neighbor, or a friend.
Although federal law does not demand a background check for the private sale of firearms, some states do require a background check.
If you inherit or are gifted a firearm, you don’t need a background check.

Do Gun Background Checks Differ By State?

Thirty states, five districts, and D.C. all rely solely on the NICS for gun background checks. The following 13 states use their own full point of contact (POC) data system for gun background checks and do not use the FBI’s system:
Some states, namely Maryland, New Hampshire, Washington, and Wisconsin, use NICS for long guns, but a state program for background checks on handguns. Iowa, Nebraska, and North Carolina use NICS, but have a partial POC for background checks in relation to handgun permits.
Many of these states have added their own provisions to their background checks, on top of what federal law mandates. In most cases, they also include looking at state and local records to determine if the person in question should or should not be allowed to own a firearm.
Some states have implemented universal background checks via an FFL, even during a private gun sale. While Maryland and Pennsylvania require background checks for all handgun transfers, regardless of retail or private sale, the following states require a background check for all firearm transfers:
In addition, some states require permits to purchase firearms. Hawaii, Illinois, and Massachusetts require a permit for all gun purchases, while Iowa, Michigan, Nebraska, and North Carolina require a permit for purchasing a handgun. These permits often require their own background check as well.
It should be noted that although these laws exist in Nebraska, they’re not currently being enforced, but are expected to be by January of 2020.

But Isn’t There a Gun Show Loophole?

There is no gun show loophole when it comes to background checks for gun purchases. The law clearly states that if you purchase a firearm from a person with an FFL, a background check must occur. If you purchase a gun from a private seller, you don’t need a background check. These same two principles apply whether you’re at a gun show or not.
So if you purchase a firearm from a gun seller with an FFL at a gun show, you will need to complete Form 4473 and have a background check. Under federal law, if you purchase a gun from a private seller at a gun show, you don’t need to have a background check. Your state laws may differ.
Of the average 4,000 gun shows in the U.S. each year, it’s estimated that 50 to 75 percent of vendors have an FFL, and therefore require purchasers of firearms to complete background checks. But that doesn’t mean that 25 to 50 percent of vendors are private sellers of firearms – many of these are vendors that sell gun paraphernalia. Gun shows are filled with vendors who sell everything from t-shirts and ball caps to holsters and concealed carry gear, and it’s these sellers that make up the majority of the remaining non-licensed vendors.
Are there private gun sellers at gun shows? Absolutely. But the idea that criminals are flocking to gun shows to illegally purchase firearms is untrue. In a report by the Bureau of Justice Statistics, only 0.7 percent of convicted criminals purchased their firearms at gun shows.

Have Background Checks Stopped Gun Violence and Crimes?

The research on the effectiveness of background checks to stop gun violence shows conflicting evidence. In an October 2018 published study completed by U.S. Davis and Johns Hopkins Bloomberg School of Public Health, in the 10 years following California’s comprehensive background checks, the number of gun homicides and suicides were not impacted. In a similar study published in July of the same year, gun violence did not increase with the repeal of comprehensive background checks.
Yet other studies show that background checks do reduce violence. A 2015 study found that requiring Connecticut handgun owners to go through a background check led to a 40-percent decline in gun homicides and suicides over a 10-year period.
This contradicting research shows that the problem of criminals getting their hands on guns can’t be stopped by mere background checks. According to the Department of Justice Special Report on Firearm Violence, 77 percent of state prisoners associated with firearm crimes received their firearm through:
  • Theft
  • Black market
  • Drug dealer
  • On the street
  • Family or friends
Not one of these criminals would have been affected by background checks, universal or otherwise. After all, most criminals don’t feel obligated to use legal means to obtain their firearms since they've either broken laws previously or plan to do so.
Beyond theft and the black market, criminals also use straw purchases, which are illegal, to get their hands on firearms. Straw purchasers are people who can pass a background check and intentionally purchase firearms for criminals. The San Bernardino terrorists used a straw purchaser to get the firearms they used to kill 14 people in the 2015 mass shooting.
Background checks for gun purchases often become a talking point after these types of events, but those who partake in this terroristic activity often don’t have criminal histories that would flag a background check. For instance, the Virginia Tech madman legally purchased a gun at a Virginia-based FFL and passed his background check before using it to shoot fellow students.
And then there’s the fact that sometimes the background check system fails. NICS is not a 100-percent absolute system, and time has shown that gun background checks can only be as reliable as the records they contain. Devin Kelley, the Texas Church madman, was prohibited by law to own or purchase a firearm because of a domestic violence conviction while in the Air Force. Yet Kelley purchased four firearms between 2014 and 2017, completing Form 4473 and being approved each time by NICS.
In this case, the Air Force failed to report the court martial to the FBI’s National Crime Information Center, which the NICS relies on for information. So, again, the system is only as good as the information it contains.
(It's also worth pointing out that Kelley's murderous rampage was stopped by a private citizen, a plumber named Stephen Willeford, who legally owned an AR-15. Kelley was shot in the leg and torso by Willeford, stopping him from murdering more people inside that church before the police could arrive.)
And whereas sometimes the system on which gun background checks rely is incomplete, in other instances it produces false positives. In other words, law-abiding citizens get incorrectly matched by NICS, or their respective state-level POC data system, with criminals who have similar names. And if that happens to you, then you could be denied your right to own a gun because of a bureaucratic error. Estimates from the Crime Prevention Research Center pointed to 93 percent of initial NICS denials turning out as false positives in 2009, with similar estimates in 2010. (The Obama administration quit reporting these statistics after 2010.) Yes, individuals can appeal this denial and restore their gun rights, but dealing with bureacracy can be an expensive hassle.
The myriad of issues with NICS is why the National Shooting Sports Foundation (NSSF), a trade association representing the firearms industry, launched FixNICS.org in 2013. It is also why the NSSF publishes a yearly ranking of the states based on the number of mental health records they provide relative to their population – to encourage the states to comply with existing federal law, and submit any and all records establishing an individual as a prohibited person to the FBI's databases. Their goal is to improve the existing system for everyone so that gun background checks are more accurate and complete.
Whether you like them or not, background checks are here to stay for gun owners and gun purchasers – but they are not the saving grace that some make them out to be. Background checks for gun purchases can only do so much and are not the permanent solution to keeping guns out of the hands of criminals and keeping Americans safe from gun violence. More concerning is that they give the state an ever-growing list of private citizens who own guns, and such a list has historically been used for subsequent gun confiscation attempts.

Ohhhhhhh girl no way. Your my most trusted. yesterday was rough Beverly they're trying to create issues where I have to stop. Feeding America is not here to help us they're here to create issues so that I'll stop. I'm not stopping you had every right to lose your patience yesterday was horrible I came home and cried for hours. I'm frustrated that the city is making this all so hard they did not send out any police help yesterday they did not help me advertise they did nothing nothing at all to help.I'm laying here this morning telling Danny I don't know if I should stop or keep going. Literally as I'm writing this to you I'm crying tears are pouring down my face because at the end of the day no matter how hard this is no matter how hard everyone is trying to make it no matter how beat up my body feels and believe me I feel really beat up today I can't stop thinking about those faces and how happy they are for that little bit of food. Think about it we give out just a little bit of food just enough for a few days yet people are literally crying grateful for it. Send me the information on the guy who made you carry everything in. No matter what if I'm able to keep pushing 400 boxes they will have no excuse to take our food away. At 10:00 this morning I have a meeting to secure our office. My plan is to shift the giveaways over to the VFW eventually we will be doing nothing but getting the food and making up boxes storing them and handing them out as needed. I don't have an endurance I simply have a professional background. I appreciate you so much. I don't want to lose you on my team. Is this the same guy that had the code enforcement there📷

Buck: Welcome back to the show everyone. Today my guest on Wealth Formula Podcast is estate planning attorney Joseph Longo. Now for 25 years, Joe has focused on delivering unparalleled service in the area of estate planning asset protection, and sports actually. His clients have ranged from businesses to high net worth families and professional athletes he has taught law school Los Angeles City College, Mission College, and Pasadena City College. He is currently an adjunct professor at Loyola Law School. He's also sat as a judge pro temp in the Los Angeles Court System. Joe is an Ivy League guy. He received his BA from Brown University in rhode island where he was a starting defensive back on the Brown University football team in the mid-80s. Joe, welcome back to the show.
Joe: Thank you, thank you very much Buck for having me.
Buck: Hey Joey I gotta ask, did you play at Brown when this guy I think he was on the Vikings, I think, Steve Jordan?
Joe: No he, okay so it's funny, he was a little bit ahead of me and I think I was a senior in high school and I was like a mid-major recruit like you know Washington State, San Diego State, Utah and my father who never went to college and lived the American dream when Brown University came to visit us to talk about going to school there my dad was really into it and Brown did a smart move they had that the one NFL player called the house Steve Jordan so my dad at that point said look if you go play in the NFL you got it covered but more importantly you're going to get a good education and of course I went there and got a good education.
Buck: That's great, that's great. Yeah it's funny I was trying to think actually when I read about the Brown thing I was like you know and I'm such a rabid NFL fan I've been a Vikings fan since kindergarten and Steve Jordan played a while ago but I was like he was tied in on a Minnesota Vikings you know late 80s I think and he was a very good player. At any rate it's interesting, just a little side note there. Well listen Joe I contacted you because you know we've been on the show before, but you know we've got some timely things going on right now with regard to potential change in the state law tax, the potential Biden administration etc, however I do think it's always important you know for many new listeners all the time on this show and it always helps to review some of the basic concepts so if you're okay with that, what I'd like to do is just kind of you know brush over some of the basics here. And so why don't you want to you know at a high level just say for example what exactly is estate planning? I mean I know it seems like such a basic question, but you know I'll tell you what, when I finished surgical residency and started making money for the first time, I had no idea what estate planning meant. So why don't you just start with a basic definition.
Joe: Well I always tell clients I say look when you're just coming up and just out of school you might be able to get away with it, single you might be able to get away with it, you're married and you have a joint tenancy on a house that's I call that a poor man's trust you might be able to get away with it, but once you have kids you need in my area of law you need your dose of medicine and what that is is a living trust. And a living trust is the entity that will hold all of your assets and it protects your loved ones, your wife, your children, your husband if anything ever happens to you and that really is the key document. Wills are also very helpful but in today's day and age it's the living trust is what you want.
Buck: So you know and this is just to expand on that point, a living trust is not that big of a deal right I mean listen people think oh trust whatever but it's a document that's ultimately you know it's not like it even has its own tax ID, it's just you know taking things out of your estate and to and basically putting it in this trust. Tell us why that is important.
Joe: You know under the law a living trust is looked upon as a contract, a customized contract by you on where all your assets go when you pass. So the law recognizes what you want and therefore you avoid probate and all the costs and fees that are associated with it your family I should say avoids probate and things transfer much more smoothly under the law and then your loved ones are ultimately able to mourn your passing and the assets transfer smoothly and ultimately your state's resolved in a much quicker more efficient manner as opposed the complexities that are involved in probate court.
Buck: And that's exactly the point I was trying to emphasize here and I tell people all the time, the living trust is not burdensome at all but what it does do is in the event that you die, which you will eventually, it allows your assets not to go through probate. Now for people who don't know what probate is, what is probate and how painful can probate be? I mean it's a very leading question but I think this is something that a lot of people just have no clue about.
Joe: Well probate is the court overseeing your estate now and it doesn't matter that you were married to the decedent it doesn't matter that you're the child of a decedent the court is in charge and that becomes very cumbersome when you can't access any of your father's account because the court's overseeing it and if you do access the account you owe the court in accounting and the attorney's fees are great and then in California and most of the seven southern California counties where I practice, the wait time for a simple probate that has no objections whatsoever right now is running about a year and a half to two years. For me to run assets through a probate it takes me about a year and a half to two years to get those through into the heirs or the children or whoever I'm getting it through the attorney's fees are very expensive, it runs about you know around two percent and up of the gross value of what you run so just take a a regular million dollar home. Your attorney's fees for pushing around paper for a year and a half to here is going to be about 20,000 there's core costs there's an appraisal involved I mean a simple living trusts are running anywhere from three to six thousand dollars in most cases and that includes all the health care directives and everything else so you understand just the fees alone are burdensome on your loved ones and most people in my practice once you explain them what a living trust is, how it helps your loved ones, most people are willing to invest in getting their estate plans set up and not and being taken care of you know.
Buck: That's right and the thing here to emphasize is and it's not just California. Of course you know everybody thinks California is slow and clunky with everything they might be right but this is probate is an issue in every state to a certain degree so imagine this if you are you know you've got a wife or a husband or whatever and you've got a few kids and you've got a 5 million dollar net worth and you know you have a bunch of stuff that's in your name right it's in your name and all of a sudden you die. And in California your assets don't go you know they're I mean in any state they're not going to go directly to your kids just because that makes sense, it's not going to happen. So your assets are going to be hung up at minimum in California two years and in other states it's you know it's not going to be any shorter than six months to a year right. And then it's going to cost you a bunch of money. Imagine that your family is going through you know this pain of losing you and all of a sudden they don't have any money. It's crazy so this is exactly why Joe saying the living trust is basic and fundamental. Did I see anything wrong there?
Joe: o your analysis is exactly right and like I said it it helps your loved ones with the transition.
Buck: So now this is the next the next issue I want to bring up here is that now once you get your living trust, use it right. This is something that's again something that I see all the time I've got a will I've got a living trust but I'm investing in my personal name I own my assets my investments through my personal name I own my LLC's that you know I'm deploying capital through or have holding companies and they're owned by personal names so all of those things then should actually be owned by a living trust is that correct?
Joe: That is the number one problem I see in just over 30 years of practice is people do a trust and then they don't bother putting things in it and we call that funding the trust. So let's make this clear it's not what you list in the back of the trust in schedule a that's not in the trust just because it's attached, it's the title of the asset being in the name of the trust is what makes it in the trust and that's the biggest problem I see is people who do the do-it-yourself trust through those companies or maybe just a you know didn't get it done correctly or gathered a bunch of assets after they did the trust and didn't bother you know remembering that they were supposed to put in the name of the trust. I tell the clients the children usually of the clients look your father you know did a good job by making a trust the bad news is I gotta go probate these two homes or these two pieces of real estate because they're in his name not the name of the trust.
Buck: It's funny because again it's one of these things that it sounds like this is not sexy stuff but this is critically important stuff right I mean this is critically important. You know when I have an LLC and now it's a little different because most are owned by you know different types of trust which we'll get into in a minute but you got to go back and look at your LLC's to make sure again just because it's an LLC does not then preclude it from being part of probate. If you have an LLC with assets or investments etc it again has to flow into that living trust to avoid probate. So okay and by the way again just to emphasize it's so easy once you get the document you know I just bought a couple cars this year and you know I was like well where should I title these? Well I just put it in a living trust and you know big deal I use my social security number for anything that information it's not even like there's a different tax ID it's just you know it just avoids probate. So it's that simple okay. So now we wanted to make sure we hit that stuff to begin with because I always feel like you know get the basics get the basics if nothing else you didn't know that now you know that that was the price of entrance for this podcast. So there's another level though Joe as we so to speak as we start getting we start getting trusts involved right and other types of estate planning that's more sophisticated. So from my understanding that's when you start get concerned about you know as you're when your net worth is going up when you're when you're starting to accumulate assets so that's when these issues come up potentially where you start thinking about estate taxes. Now most people even in my group so my investor club etc really didn't need to worry too much about that kind of stuff because you know they really didn't kick in these you know state taxes until like if it was a couple maybe 20 million plus range in net worth and you know most of our people are still probably below below 10 million and so it didn't really affect them but something's happening now that that could really change all that and it and it could be the case that it affects most of the people in for example in our investor club or accredited investors and that is the change in when these estate taxes start kicking in. Can you talk about the what you know sort of the buzz is in the in this space right now?
Joe: So yeah it kind of reminds me of 2012 at the end of 2012 we were going through a similar situation but the change the potential change of administration and Biden is the issue and Biden has come out and said that he doesn't like Trump's tax laws but what we don't know is we don't know exactly what he's going to do and remember he'd have to carry the both the congress and the senate if he's gonna change Trump's tax laws but he has said that he wants to change his laws. In my circles I'm hearing a lot of that he wants to bring the death tax exemption per person down to three and a half million just to give you an idea it's currently 11.58 million.
Buck: Per person so that's where we get the 20 plus we were talking about before
Joe: You can double that for a married couple okay. There's a lot out there that says he wants to bring it down to three and a half million. In fact I believe that we will probably end up in a obama era type a tax exempt estate tax exemption of between five and six million but what does that mean anyway
Buck: What does that mean and then and then how much you know how onerous is this tax
Joe: Context here so you're married you pass your wife inherits tax for everything okay that's called the unlimited marital exemption okay so spouses don't get taxed. But when the second the spouse goes the heirs which are you know 90 times children are to pay a death tax within nine months of that death and what is that? Well right now it's 40 on every dollar above 11.58 million okay. If Biden were to bring that down to three and a half million then it's and I don't know if it's 40 or 50 I mean I remember Bernie Sanders campaigning at one million dollar death tax exemption at 55 on every okay but what that would mean is our debt tax exemption is going to come down much lower than it is now so a lot of particularly real estate heavy families are coming to me and saying hey is there anything I can do between now and December 31st because because if one gets it takes office I think it's January 20th or whatever if he gets anything passed in 2021 it will be may retroactive to January 1st of 2021. So we all have between now and December 31st to examine our estate plans and see if there's any opportunity to move some assets to our children now to avoid death tax when we pass and now how do we do that? There's some very sophisticated ways to do it but the simple way to do it is gift your children now some of your assets okay so that they are don't count against the either 11.5 million or the possible pinning three and a half million okay. So do you understand if you get it out of your state now it can grow estate tax-free during your lifetime and then when you pass you avoid the estate tax.
Buck: So and this this is where it gets interesting because when what you just said I think makes a lot of people think the same thing. Well I'm not that old I don't really want to start you know giving my money away and not having control of it or not being able to enjoy it and all that but in fact that's not really necessarily what you're doing right you're not completely giving away control and there is still some ways in which you can still benefit from you know that money is that is that reasonable?
Joe: Yeah exactly let me give you a simple example okay let's just assume you have five million or let's just use 10 million dollars in real estate let's just say it's all in one LLC for simplicity purposes. You currently own 100 of that 10 million real estate LLC. How about gifting 30 which is a minority share to your two children 15 each? Well you still retain control okay you still get all the benefits of being in control of that LLC but you've now moved three million dollars out of your estate to your two children who are minority owners now of of your LLC and let's say you are relatively young and you hold that LLC for another 20 years and that thing appreciates just from 10 million dollars to 20 million dollars and then you pass well you just gave your children six million dollars tax-free, there's going to be no estate tax and that becomes valuable over time and you haven't given up any of your incidences of control.
Buck: I want to talk about something specifically that you know just in terms of my own planning I do have and maybe could be useful to actually a number of people in this audience because you know some are similar to me. But the way I'm set up and maybe you could kind of explain to people what this is because I know you do this as well is that I have set up a Nevada Dynasty Trust and the Nevada Dynasty Trust has the the owners of that trust are basically my my three daughters their irrevocable trusts so it's been decanted into there right now that that's how I have it set up. Now the Nevada Dynasty trust itself holds has a holding company and that's really where I'm the manager and what that allows me to do is is basically to you know invest that money if the kids need you know if we need to buy a house, well the kids need to live there so that's fair game right we can we can use that. Can you talk a little bit about that I don't want to be the lawyer who explains this but I find it to be a very useful structure and I'd like maybe you could explain that and see if you know to see if people think it might be useful for them.
Joe: Dynasty trusts are very helpful for our children for a number of reasons. When I was talking about gifting our children, we typically don't recommend gifting to children directly. We'd rather gift into a trust okay. And why would we want to use something like a dynasty trust that lasts the lifetime of your child? Well a few reasons. One is it's asset protected for your child so for instance when your daughter has this real estate and cash inside her dynasty trust, the future ex-husband's not going to be able to get into there. Future creditors on her bad business dealings or her malpractice claim or whatever it is she's exposed to predator-wise in life will not be able to get into that dynasty okay and so the assets are safe inside there they grow estate tax free inside there there's some other lifetime tax benefits having it a Nevada but we do recommend gifting assets out of your estate in an effort to avoid escape tax into some kind of a trust and that dynasty trust is probably you know the most common trust we use.
Buck: Let me ask you about the nature of things you can transfer into a dynasty trust. You mentioned real estate. Can you transfer operating businesses into a dynasty trust?
Joe: You can transfer anything into the dynasty trust. We just have to have it appraised so we know the value in the event of an audit we needed to have the value appraised at the time they were transferring it.
Buck: How about this, another question and I'm asking some of these questions because they're relevant to me so I'm you know I'm basically getting this legal advice for free but how about starting businesses that are owned from day one by the dynasty trust they have no value to begin with, can you do that?
Joe: I one time a very there's a very famous estate planning story that and it's out there that Mr. Hughes the founder of PS Public Storage I think he founded in 1981 and he made he he started he already was pretty independently wealthy but he started the storage business and he gave his two children who I think were in college at this time I can't remember the story but anyways he gave his two children into trust fifty percent of PS Public Storage which those interests are now worth billions of dollars okay when he passes and he's still around, I think he's of course just won the Kentucky Derby but when he passes his kids will not pay any estate tax on that 50 percent share of the PS Public Storage.
Buck: So the answer is yes you could have an active business that is starting you know from day one that has no value because it's a startup and you could have membership and grow it into you know a big pile of money basically right?
Joe: That's correct and it'll avoid estate tax.
Buck: That folks is really critical when you start thinking about some of your investments and so Joe correct me if I'm wrong okay on this because there are situations where you are you know you may be thinking about doing something for the first time and you know maybe you're already over that threshold of where the estate tax might be, you might consider starting, you can still in this situation I know at least in my diagnostic trust I'm the manager of the LLC's that owns you know the the LLC's owned by the dynasty trust. Now I actually I don't use that to go out to dinner and stuff for our vacations, but I can buy real estate because that real estate is ultimately owned by my children right, I can buy you know a home with that because that's where they're going to live and it's their home they own it right?
Joe: And as manager you have 100% control.
Buck: Exactly so I emphasize that because I literally have had conversations with friends of mine who have you know I've said you know you got to do something with your estate planning and I got to tell you Joe I don't know if you come across this all the time but you have very sophisticated people very entrepreneurial types business types who for some reason and I think maybe a psychological thing where you're just you know worried about you know giving everything away I'm not ready to give everything away and I'm not you know I'm not thinking about dying because I'm well I'm you know a pretty young guy but they just when the the idea of the word gifting comes up it conjures up these images of sort of you know giving it all away calling it a day that kind of thing and it's just not the case right?
Joe: No and I get that a lot like when the first reaction to sort of you know especially high now with people giving to their children and especially if their children are young you know the first reaction is the connotation of gift like you know and all of us want our children to you know do well in school get good jobs and work hard right, this is a different kind of gifting program this gifting program is into a trust for their benefit and the trust could either say hey you can only distribute for needs until let's say age 30 for instance, like housing medical or it could be a dynasty trust where it could serve their needs for their lifetime you could even name them as co-trustee at some point so they have access to the principal, who knows maybe you're one of your daughters want to work wants to work in the real estate business with you you know and she she can help guide your your job as manager. It's one of those things where it's a program to help you take some of your hard-earned assets and pass them down to your children tax-free. And right now we're in a climate where if the administration change happens, that estate tax is coming down not just a little bit probably dramatically okay. In fact in California there's rumblings about California having its own state tax in addition to that federal tax I just talked about. So your own states might have an additional estate tax you really need to understand if your state has your the state you're residing in has an estate tax and then keep an eye on the federal estate tax but either way this is an opportune time to look at the law and your own estate plan between now and the end of the year and see if there's something appropriate for your children. By the way I have a seven and a ten-year-old who both have these dynasty trusts that I gift into they have no idea what they have okay but my plan is to you know hopefully decades from now you know when I pass when they are responsible adults they have access to funds that will come to them tax free, won't be subject to the tax right.
Buck: Right a slightly different issue which I think again is important to a number of people in our space is you know there is a lot of talk about at least in the tax plan to remove you know the you know reset basis in real estate you know after death. Can you talk a little bit about what that is for people who might not be familiar and how that might affect them and how some of these things that we've talked about kind of feed into that.
Joe: Okay so where's where I begin in California I think we have three new tax propositions on the ballot. So as a lawyer looking and having read the propositions two of them I just think are poorly written. One being trying to get rid of the parent child exemption property tax exemption under the law. And what that means is in California right now let's just say your parents own a home your father dies your mother's living in her property tax basis is 4000 a year on this million-dollar home right. When she passes and you inherit the house you also can inherit a four thousand dollar property tax exemption that's called the parent child exemption okay. What they're trying to do is get rid of that okay. So that means and so I'm getting a lot of calls from parents or who are like should I transfer my home to my child now instead of when I die and the answer is you got to evaluate you're giving up and again this is another tax complex but maybe your real estate listeners will understand if you gift the home during your lifetime your child loses the step up and basis yeah okay but we'll get the property tax exemption so you got to do a math problem to see which one's more valuable.
Buck: But as I understand it Joe at the national level one of the potential things that could be eliminated and that's been talked about being eliminated is the step up in basis right and if that were to happen then it would be like there'd be basically no point I mean you you'd want everything in the trust right I mean there's no value in having outside the trust anymore.
Joe: You're absolutely right because if they do away the step up in basis upon the death of your parents you now have a that the date of death is the new valuation of the I mean you get your I'm sorry you inherit your parents basis so now you know if you go and sell the house you've got a capital gains tax that you well okay he's assuming most people most children that I represent that inherit the homes usually they end up selling them.
Buck: Yeah well and in that case you know they're it creates just a giant mess for real estate investors too because then presumably the they're they're not gonna the step up and basis whatever depreciation that that the parents took they're gonna end up paying recapture on the way out, recapture on the depreciation along with capital gains. So this is a gigantic mess and what I the moral of the story here is folks I think you really, really got to start thinking about this and it's not just for the 20 million plus crew anymore. This is something that you ought to be talking to Joe if you're in California. Joe you're you're you're licensed only in California and you you generally like to see people work with people in their own state when it comes to estate planning attorneys is that right?
Joe: Yes and that that is exactly because it's a state by state, state tax by state tax so you really need somebody in that state to give you proper advice both on the federal issues like the one you just mentioned that's up for debate and the state issues like the one I mentioned the propositions on the ballot in California.
Buck: Right so Joe if we're in California how do we get in touch with you?

What about for people who are not in California we have a nationwide and frankly, well we can't do anything for people outside of the country, but at least in this country how do you find a good estate planning attorney?
Joe: I'm a member of a nationwide group called the wealth council and it's wealthcounsel.com I have fined those lawyers to be top notch. My BF went on a road trip with no return date. He suddenly stopped most communication, texts and phone calls after a joke and a new puppy. Here’s the scoop. the last text I sent him is at end of the post. So scroll down and enjoy the gossip.
So my BF (M30) and I (F30) had talked about the relationship and where it was going after dating for a year. We both felt like we needed to focus on ourselves and goals before we can start planning a future. Which seems fair. I love him and respect him so much. We both agreed to spend more time apart after being quarantined at each other’s house, back and forth, sleeping over at each other’s houses, because of COVID.
By the end of August he was missing his family after being away from his hometown for a year. He moved to Oregon a year ago and he met me shortly after moving. Well, his grandmother fell which sent her to the hospital. This really scared him, to lose her, they were close, and with Covid, I can understand feeling emotional over family. He was also missing his mom who had recently recovered from severe mental health issues. She had to be instituted for shock therapy.
He went through hell and back helping his mother during her mental illness. He moved to Oregon after his mom was admitted for treatment. Probably an extremely traumatic experience for him. So I get it. He really wanted to go see his family. I supported him after pushing my feelings aside of him being away a long indeterminate amount of time. Plus we had discussed taking a break, not an emotional break by all means, just spent less time together. So this road trip seemed like good point to do things for ourselves and have the physical break and that we would still be a couple in a relationship who are best friends and love each other. Which I supported 100% and did he. We were good.
So he took the road trip to see his family in Massachusetts.
He went to California first and met up with a friend for a few days then went to Utah to help his friend move cross country. They arrived to the state his friend moved to. Mind you, this all happened within a month since he left. And will soon make his way to Massachusetts. He doesn’t know when he will be back. And I’m cool with all of that.
During his time in Cali I made fun of him for going to hooters and I cracked a few jokes. He didn’t take them well. I just thought it was funny that he went to hooters. Like come on! You’re in LA and you go to Hooters? Lmfao. I know I’m not the only one thinking thats funny. It’s just funny. So I cracked a joke about how it’s a sin to be at hooters as a conservative man. He identifies as “conservative”. So given the nature of the style of service hooters provides, “Objectification” and “sexualization”- by all means I don’t think hooters is evil or anything. I’m also not jealous either. I’m an extremely beautiful woman myself. I support women 100%. I’m pretty liberal. I support sex workers etc. etc.- I thoughts cracking a joke about when conservatives and a group of feminists where cracking down on the local hooters’ that South Park made an episode all about it, that the joke would be funny. Especially because he had mentioned watching South Park the night before. But I joke pretty hard. I like dark humor. So he didn’t like my joke. I offended him I guess. I did apologize and said I went too far. I get it. I can take responsibility for that. But then again I joke like South Park jokes. I would be the person writing South Park episodes.
So ever since he got upset at me about it. Stopped talking to me. And avoided my texts and phone calls. If he replied it was distant. He hasn’t said I love you back or I miss you. Then on a phone call that was meant to be brief, he tells me he has an issue with me being married to my ex who I have a child with because he is a conservative man of faith.
Let rewind for a bit now!
I never got divorced. Partly because at the time the relationship between my EX and I was toxic and neither of us had money. We were broke as fuck. So years went by. It has been 6 years since the breakup.
I was honest about my past and honest about my forgotten marriage from the beginning of our relationship. I’m a single mom. I have a job. I have Priorities, and my relationship with my son and his father is 100% amicable to the extent of it pertaining to only our child’s well being. I absolutely have no emotional attachment to my EX because he abused me and I had to recover from his abuse with therapy. Which I did. But it took years.
So I’m healthy now, mature and aware enough to engage in cordial coparenting. No more drama. My son is happy and loves both of his parents. He is a healthy young boy. I am proud of my son and his development. The separation took a toll on him. As I healed so did he.
I decided to get a Dog for my son (M9) because he has been sad die to COVID and being unable to see his friend. I love my son and will do anything for his happiness. both his dad (EX) and I agreed to get him a puppy. the puppy would belong to my son only. That means the dog will go where ever he goes. To me this was a great idea because the dog would be at his side at all times for emotional support and he wouldn’t have to worry about the dog only being at moms or dads. The dog was meant for him, to protect him, and give emotional support.
When I got the puppy I slept at my EX’s house to help with the 3 month old puppy. I did not cheat. Swear on my grave. I would never! The stay was meant for adjustment purposes. I slept on a couch. I was there to give my son the joy of him sharing a happy moment with both parents. I was there for 2 nights. I have my snap chat location on so my BF sees where I am. I was open and honest about what the plan was with the dog. He was ok with it. We were good.
My BF seemed ok with all of this. 2 days go by and suddenly he started to avoid my texts and calls. He got pretty irritated with me one night. He yelled at me after I asked him if he was ok and that I was sensing a change in behavior and communication from him.
He claimed that I am still committed to my ex, that if anyone can’t commit its not him but me, he said that me getting the dog is taking a jab at him and I’m robbing him the idea of our 1st dog in the family, our family, and that he as a conservative Christian can’t be with a married woman. This SHOOK me. It hit me hard. Kind of like a whole year late there huh?
I reassured him that I love him only and that I am 100% committed to him. Because I am. I want a future with him and I can be patient and not put pressure on it. I reassured him he is loved. I understood his feelings and view. I supported his emotions and I thought they were valid. So I gave him reassurance. We ended the call with I love you’s. He seemed to sound better after I heard his feelings.
I love him. Absolutely love him. Even through the hard times. I love him immensely. So it hurts how much he pulled back immediately again after that phone call. I thought we were good. It worried me that he was festering his feelings and closing up, when we were usually pretty intimate and open with each other.
He delayed texting me. Ignored my calls. And I was easy with it. I got annoyed at it once and told him It was hurting my feelings to be ignored. 2 days later I try to reach out to tell him about my hike and promotion at work. He yelled at me a second time telling me that I only care about my feelings, that he isnt going to force an I love you, that his priority is his family, that I am not a priority anymore and that he doesn’t have time to miss me. I remained calm and reassured him I loved him, told him I’m here to talk, and that he can trust me. The next morning he sends me a text saying good morning and congratulations. I was hurt so I gave it a few days. I didn’t want to hurt him with irrational words coming from pain.
I started to reach out over the weekend. But my attempts were all cut short. He ignored all my calls. Never responded to my i loves you and miss yous and have a good days. I feel like he is hurt over the puppy that will be co-cared by both me and my EX. I’m not sure if the joke about him being conservative also hurt him. But anyways all of this has made him ignore most of my texts and calls. Actually all of my calls this week.
I am not blasting his phone at all. I’m living my life. Doing so many fall activities with my son. Im going on hikes and fun places! I love having fun. But it doesn’t mean I feel hurt by his sudden change in behavior and lack of communication. I am afraid he is pulling back because he is going to break up with me because he thinks I cheated or that I am leaving him out. I wish he was with me doing fun things and getting to know the dog. But I understand he has friends and family to visit. A risky move during COVID. But I support him. So after him avoiding me for 2 weeks now. Im feeling anxious about it all, I’ve come close to panic attacks, I probably did have like 3 already. I sent him this text:

Me: Well I was thinking we can talk on the phone. Been a few days. I know you’re tired and stuff. So it’s all good! I love you and I miss you! I would love to hear your voice! Also, if there’s something going on don’t be afraid to talk me me. I’m here for you. I hope things between us are secure. ❤️
Me: I called. But you keep pushing me away. It hurts. But I understand. I love you and I want to be there for you. I left a kind voicemail. Please listen to it. Communication is important. But if you wish to not communicate with me please let me know. I hope you can find the peace, strength and clarity in your heart to be able to talk to me. I can’t help but sense that something is hurting you. Always remember that you are amazing just the way you are. And you are blessed. You are absolutely beautiful inside and out. You are the most handsome person I’ve had the pleasure of being with. And your personality is my favorite. It’s ok to feel confused. It’s ok to feel hurt. It’s ok to feel unsure, depressed or anxious. It’s ok to want to end things with me or to cut off communication. But it needs to be communicated. I hope breaking up is not the case. But my heart hurts and I’m no stranger to the patterns of a person who is pushing away with break up in their mind. But I have faith that this could just be a rough patch. That you are overwhelmed with life, traveling and your family. You are loved by everyone and it can get hard to stretch yourself thin to meet everyone’s needs. Please be honest with me and understand that avoiding talking to me and avoiding intimacy hurts the foundation of our relationship. I am 100% committed to you. I’m here to lift you up not down. But if you have no desire to be close to me please let me know before I pour my heart out for you.
I am a lover. I am a fighter. But I can also step away when and where I know I’m not wanted. I would hate for us to end in ambiguous ways that create pain for us, making it difficult to heal. We both deserve and are deserving of healthy communication and relationships. We both are deserving of compassion, understanding and forgiveness. Good night. I will not reach out from this point onwards. I will give you the space you need. But I do request clarity and communication sooner than later. I’m hurting but I don’t want to hurt you. it started when i left highschool, i moved to utah with a friend, got a job at a pizza place, and became friends with great people .
I moved job a year later in the year 2013, and i started doing sales, phone sales, vivint sales, and internet. I loved my life so much at this point, and then i become friends with a girl on a dating app, the app was meetme, and sure enough we kicked it off, because i was desperate, and from there it was good for a few months, shit i was stupid and young, (still im) but needless to say i asked this girl to marry me, she said Yes!!!!

but that was where it quickly turned down hill, a month after i asked. she said she was going on a cruise and i was happy for her, she was going with family, so anyways, she goes, and when she was suppose to get service , i got dead air nothing!!!, but i was sad and upset, thinking she left me. She did leave me, but after a few weeks, she decided to call me, and explain, that she wanted to break up, and that she was pregnant(to this day i still dont know, as i cant find then, somewhere in texas i think) but needless to say, depression hit hard, and then when i found out, she tossed the ring i had made just for her , and she tossed it over the cruise she went on, mad it worse, but yea it sucked, i gor fat, lazy and hurt.

Still doing sales, my numbers took a huge hit, i become just a sales rep, when i was sales person of the month many times, never wanted a family again, just wanted to be alone, and just be with woman to sleep with them. My room mate at the time, got me involved in linux machines and setting up servers for webhosting, and i was really good at this, took some time but landed a great job, and so began my career as a web hosting tech, working with bare metal machines, ( company called bluehost.) durning this time, i was becoming happier , and sure enough got back on meet me, and had a few flings some fun, but this lady got my eye, super sexy and cute as hell . i asked her to come over and lets do it, we did, and i asked her to stay the night, and in the morning made/got breakfast, i did like it for her body, and i wanted to know more, .......

Have We Arrived? Revisiting and Rethinking Responsibility in Writing Center Work: The Need for Transformative Listening and Mindfulness of Difference,Special Summer 2021 Issue,Praxis
The history of writing centers and writing center work is one of regulation, service, and academic policing of students who “don’t belong” in academic settings (see Faison & Treviño; Newman & Gonzalez; Green; Burrows; Keaton Jackson; Villaneuva; Grimm). As scholars such as RomeoGarcía (2020), Harry Denny (2010), Beth Boquet and Neal Lerner (2008), and Nancy Grimm (1996) have discussed, many writing centers were created and flourished during the 1970s, “as the Open Admissions movement brought larger numbers of ‘underprepared’ students to higher education” (Boquet & Lerner 172); as such, writing centers are born out of regulation, policing students “who don’t measure up” (Grimm 6) and who needed fixing; inclusion, thus, meaning a “technology of governance” (Ahmed 163) over who enters and how they are to act This is a history that currently, we--as writing center professionals and scholars--have still not come to terms with, as much of the work we do, despite perhaps our “good intentions,” is regulatory, even as the field embraces progressive narratives of social justice and anti-racist work. While we acknowledge the good and important social justice and anti-racist work done by scholars in the writing center community (Condon; Dees, Godbee, & Ozias; Denny; Denny, Mundy, Naydan, Sévère, & Sicari; Geller, Eodice, Condon, Carroll, Bouqet; Greenfield; Greenfield & Rowan; Hallman Martini & Webster; Lockett; Madden & Eodice), and work that is reflected for instance in a recent special issue ofPraxis,Race and the Writing Center, we also believe it is necessary to continue to interrogate this call for responsibility that largely draws its meaning, like the writing center does, from a haunting.
The writing center is a haunt(ed/ing) place. The work of regulating and policing is unfinished. This CFP, thus, asks for writing center professionals to revisit notions of responsibility as we reconcile with a past that is “haunted,” and to recognize and acknowledge that our writing centers are still predominantly white spaces that privilege white standards of languaging, knowledge, and being (seeGarcía; Inoue; Martinez). Hauntings, or in this case the epistemic work of managing, controlling, and policing places and bodies, centers and indeed demands a different kind of work of and from the writing center community: a bearing witness to hauntings, rather than an exercise in politicking responsibility apart from and outside of it. A framework of hauntings, for instance then, would bring a critique to bear on a responsibility that has long masqueraded as well-meaning rhetoric and that has long allowed well-meaning and benevolent white bodies to announce “I/we have arrived.” Such an announcement comes at the expense, too often, of thosewho will never have arrived--policed bodiesincluded under the agenda to make them into proper subjects. A revelation of one’s own whiteness, of the whiteness of a place such as the writing center, we argue, does not remove the haunt. The writing center is a wound(ed/ing) place (see Till; Basher et al.;García).
Drawing fromRomeo García’s 2017Writing Center Journalarticle, “Unmaking Gringo-Centers,” the 2020 SCWCA conference, hosted by Oklahoma State University, aimed to have conversations on transformative listening and cultivating a “mindfulness of difference,” at the conference and, hopefully, carrying this mindfulness back to our writing centers. InGarcía’s “Unmaking Gringo-Centers,” he asks the writing center community to listen “well and deeply” to how the writing center community has discussed race and racism in our spaces and how we have pursued anti-racist agendas, which have often been reductive and born out of white guilt. The type of transformative listening, or community listening (García 2018; also seeGarcía and Zhu),Garcíacalls for is centered on justice and understanding, a listening that recognizes that the writers that we meet and work with in our centers are “shapers of language, discourse, and modalities of agency” (García 13). Through this type of listening, a listening that requires those of privilege positionalities to recognize the necessity to learn with and from difference; to understand institutional and historical power dynamics; to reconcile with a history of whiteness and domination; and to value lived experience of others, writing center professionals can perhaps begin to do thework of social justice in their writing centersotherwise. As the writing center staff at Oklahoma State was working withGarcía’s “Unmaking” article, we askedRomeo Garcíato be the keynote speaker at the SCWCA conference. The OSU WC staff found his nuanced discussion on race and embodiment and his intentional use of decolonial theory, recognizing the problematics when decolonial work is metaphorical, helpful for our own space and place in Oklahoma, working in a state that is just beginning toacknowledge its violent history of the removal of Natives from their land in the 1800s and its continual erasure and silencing of Native bodies and systemic racism in dominant discourse, and at a university that resides on settled indigienous land of the Muscogee nation.
García poses an important and necessary question for the writing center community in his 2020 SCWCA keynote address: “Have we arrived? Will I ever have arrived?” These questions set the stage for talking about writing centers as haunt(ed/ing) places and for thinking about the traces of presence of minoritized and racialized bodies that will never have arrived. He further elaborates on these questions:
The question I ask myself...the question I ask you, ‘Have we arrived, will I ever have arrived’? The former is an indictment of sorts, on a benevolent ethos and sense of academic responsibility. Since Neisha-Anne Green’s indictment on an academic and benevolent sense of responsibility at the 2017 IWCA Conference, some of you have replaced your safety pins that used to read “ally” with new ones that now read “accomplice.” But both actions draw their meaning from a haunting and an epistemic crisis to be sure: how to overcome one’s own whiteness? But what is responsibility without a careful reckoning with inheritance, dwellings, and haunting? I have moved away from concepts such as rhetorical listening over the years then, for the “community” functioning within rhetorical listening, much like that functioning in the transition from ally to accomplice, maintains the white body as a universal frame for understanding difference and positions this body as the loci of and for change. They assume a revelation, such as their own whiteness, corresponds with an arrival of an ethic or a responsibility otherwise that no longer has to be questioned thereafter...
The writing center, as I saw it at the time of writing “Unmaking Gringo-Centers,” was a prism by which to see the management, control, and policing of spaces and bodies. The latter question--will I ever have arrived--, thus, reflects the haunt I feel in my bones, the reality I experience--much like that of the students I know from the Lower Rio Grande Valley and the minoritized and racialized students I have taught over the years--of beingforced to practice a hope, in and from anothered place and a denied subjectivity, that hinges upon two seemingly antithetical dispositions, anassent (así son las cosas) and anawaiting (a hope for that which may or may not arrive) (García 2020; also seeGarcía and Cortez 2020). The reality that one makes achoice to enter a space such as the writing center is really not a choice at all but a demand. And as many of usarriveat the writing center, hesitantly uttering the words, “can you help me,” we encounter and observe our bodies being read and treated in certain ways. We are left wondering, will we ever have arrived?
Our traces of presence have long been covered over by well-meaning rhetoric and benevolent bodies. But if we listen well and deeply, we will encounter sounds from the silence and presence from the absence; the writing center is a haunt(ed/ing) place...
We aim to explore the two questions above in this special issue ofPraxis. How might we re-envision the writing center as a haunt(ed/ing) and wound(ed/ing) place, and re-envision writing center narratives under a lens of responsibility and a ‘reckoning with inheritance, dwellings, and haunting’? What new stories might we gain through transformative listening and a more thorough understanding of what the work might entail for those invested in social justice and anti-racist work?
This CFP stems from the original 2020 SCWCA conference theme that was ultimately canceled because of COVID-19, as many conferences were. We believe that conversations centered on racial justice, responsibility, and reconciliation of haunted histories both institutionally and nationally, are needed now more than ever as we are working and living in a climate that privileges ignorance and dismissal of racial violence, historical atrocities, and environmental crises. With the generous support ofPraxis, this CFP gives the writing center community the opportunity to extend their work and conversations on arrival, responsibility, transformative listening, and mindfulness of difference in order to better the work we are doing with social justice initiatives and practices, anti-racst work, and to advocate for institutional change in our policies and procedures as we rethink our ethics and ways of being.
Submissions might explore, but are not limited to, the following questions and topics:
  • What might accountability and responsibility look like for WC directors, administrators, tutors, and other WC staff, particularly those invested in social justice work? How do white WC professionals move beyond the metaphorical work of allyship and account for their own privilege as they do social justice work?
  • How might those in positions of power and privilege (ie., white writing center directors) give up space in their WC missions and agendas, particularly those invested in social justice work, for POC scholars/administrators/tutors? How do those in power do the work so that they do not exhaust those at the margins of writing center communities?
  • Exploring the idea of arrival, what does it mean to “arrive” in the writing center and how can the WC community reconcile with past histories of regulation and policing in order to advocate for structural and institutional change?
  • What might transformative listening look like in writing center work? How can we work towards mindfully incorporating transformative listening in our pedagogies and practices?
  • How can WCs move from “white centers” to “centers of becoming”? What does this look like? How can WC practitioners and workers and the students that we meet work and learn from difference in their sessions? How can we foster a “mindfulness of difference” in writing centers?
  • Utilizing decolonial theory and addressing the colonial histories of Mexican-Americans in the LRGV, Garcia asks that we train our consultants to be decolonial agents in our spaces, understanding our local histories and ways in which white people continue to dominate both institutional and societal communities, in order to participate in social justice work. In what ways can WC professionals educate consultants to become decolonial agents? In what ways can WC professionals educate themselves to become decolonial agents?
  • In what ways do writing center staffing practices, hiring decisions, university partnerships, policies, and procedures perpetuate and/or disrupt larger and local systems of domination and structural difference?

For this issue, the recommended article length is 6000-8000 words for focus articles; the editors will also consider shorter pieces as columns, as well as book reviews. Articles should conform to MLA style. While we strongly encourage members of SCWCA to consider applying, this call is open to the entire writing center community (and beyond) and all articles will undergo the peer review process. We are especially interested in featuring contributions and work from BIPOC scholars, those at HBCUs, HSIs, MSIs, and two-year colleges, and graduate and undergraduate tutors and students. So my friend who's on a mission in Arizona emailed me and asked me how I was doing since it had been a while since I'd written to him. In case anyone wants a good gay Mormon sob story, I decided to copy and paste the email into a Google Doc to share with people I'm coming out to (warning: kinda long).

tldr, this is coming off the heels of me finishing my own mission, part of which I served in Japan and the rest in my hometown as a service missionary after my mission president mentally abusing and gaslighting me, among a whole lot of other shit I have going on.
I want to start dating other guys at my school, but every time I open up Tinder I panic and close it. I'm too scared to tell my parents that I want to date guys (I came out to them but they've had the don't-ask-don't-tell approach where if we ignore it long enough it will go away). I only just recently came out to my brothers, so the circle of people I'm out to is small. My dad is super hardcore MAGA and pretty homophobic, though he hasn't said that he hates me for being gay, but I really don't think he'll support me in a gay relationship, and I do rely on my parents financially since I'm a zoomer in pre-med; I've got no money and no time to make money.
I don't want to be involved in the church anymore because any organization that tells people to suppress their sexuality and illegally uses their money to promote less civil rights for people is toxic, not to mention the shitty Utah Mormon MAGA culture I've had to deal with at church. Church is not an appropriate place to rant about how much you hate socialism, dickheads.
The closest thing I've done to dating a guy is joining my school's LGBT+ support group, which is great and I enjoy it, but it isn't exactly the environment to be looking for dates, especially since it's on Zoom. I've got an appointment with the school psychologist who specializes in working with LGBT+ students, so I'm hoping that she will be able help me build my confidence.
I've been browsing this sub on and off the past few days and seen several stories similar to mine. Does anyone have good advice? I'd greatly appreciate it.

A Muslim colleague of mine who was born in Iraq but grew up in Southern California has been processing the death of her father, who recently passed away from COVID after 50 days in the ICU. Most days, she posts her well-composed thoughts on Facebook, often with images of flowers she’s picked or walks she has taken. She takes it day by day, thanking god for the wealth of memories she has of the good times and conversations she had with with him while he was alive. She parcels out the necessary emotional labor rather than letting the grief run rough-shod over her or falling into a depressive state wherein she is unable to do anything else in her life.
I see her method as very practical, and as my parents begin to face medical issues in which their fates are uncomfortably uncertain, I see her example as instructive, and I file it away in my head.
The first time I felt the dark specter of death drift near me was when I was 14, when my paternal grandfather died suddenly. He and I weren’t very close at all, but at the funeral, I saw him lying, pale and still, in the open casket. It disturbed and saddened me so much that and I couldn’t contain my emotions. Both my brother (12 at the time) and I were sniffling and whimpering in the pews while my dad and his siblings stood at the pulpit and shared words they had prepared. It seemed like my brother and I were the only ones having trouble “behaving”, as most others seemed dry-eyed or quiet, even though some of my cousins would have known my grandpa better than we did, simply due to living in the same state as them (Utah; I used to be a Mormon). It was quite strange, and I have often puzzled over this.
One conjecture I have is that to have been a true-believing Mormon, I would have been certain that my grandpa had passed on to a better place, and thus, my mood would not have been so bitterly sad, but would have been considerably sweetened by this faith-driven “knowledge”. Another thought I have is that my extended family were not less sad, but rather, much less inclined towards public displays of emotion... a habit perhaps passed down from salt-of-the-earth Anglo-Saxon immigrants in a religious minority that places emphasis on the cultivation of an aura of piety and domestic integrity. My dad is partial to the first theory, and we both have long believed that the social demands and expectations of living as a Mormon can stifle the experience of real emotional depth, and that living in this cult can create a restless, depressive, grayed-out life.
Indeed, since leaving the church at age 15, my life has been much more emotionally tumultuous. However, I’m not sure how much of that is due to leaving the church or due to simply growing up. One thing’s for sure: I have explored my heart much more deeply and fearlessly while living beyond the circular read-pray-read narratives of that narrow world. I know myself now. I feel less innocent and less good. I think about the eventual day of my parents’ deaths, and I wonder how I will feel. To date, two vivid nightmares in which each of my parents died - one of them despite my best efforts to save them - have pulled me through an emotional wringer before I woke up and felt depressed for a whole day afterward. In real life, when it happens, I think that though I will feel the capacity and the need within me to wallow in a dark and lonely space, the demands of adult life will quickly force me to focus and lock those feelings in a box, until an appropriate time. I am certain I will probably respond to their death(s) with carefully parceled out grief, much like my Muslim colleague did.
Is this just the natural end of growing up? Of adapting to the western society in which I live? Or is it my former religion that influences how I behave and how I allow myself to feel in this hypothetical situation? Is it her religion that influences her to behave and experience her feelings in this way? Or is everything I’m describing pretty universal in people’s experiences of the death of loved ones? For those of you who have left Islam, how do you feel the teachings of your youth have influenced the way you respond to momentous events like the deaths of people you know? Are there scriptures that were particularly meaningful to you, and which helped you get through difficult events like death of people you know... words that helped your bitter feelings turn a bit more sweet or at least a little bit less abrasive? Or, is there a place in Islam for uncontrolled displays of grief? Does the answer to this question vary by culture (I imagine the answer might be different in, say, Egypt than in, say, Pakistan)? I know there is a tradition of women wailing that can still be found in various places (Iran, for example), which goes back centuries. As I understand, one could even hire such women to perform this service at funerals. Does this date back to pre-Islamic Arabia? If so, did a Hadith cement this practice within Islam, or condemn it? What were the motivations behind this? Is there a belief that grief is something to be shown, but in very specific places and by certain people?

When the Toronto Raptors and Vancouver Grizzlies came into the league (in 1995), expectations weren't terribly high. They felt like filler teams, made for Michael Jordan to break records against. Maybe they'd have a playoff appearance here and there, but there's way that they'd ever be an elite contender. There was no way that some random ass team from Canada would rise to the top of the league. Sadly, Vancouver has fallen off the map (for now), but Toronto has exploded as one of the best stories and best franchises in the association.
This fairy tale didn't happen overnight. The Raptors had some nice moments and nice young stars in the past -- Damon Stoudamire, Vince Carter, Chris Bosh -- but they won a grand total of 1 playoff series over their first 20 seasons in the NBA. Given that, their latest stretch has been remarkable. They've won 48 games for seven seasons in a row, including 50+ in each of the last five. They won with Kawhi Leonard, but they managed to survive and stay relevant without him as well. Making the playoffs has become part of their DNA. Masai Ujiri, Nick Nurse, and Kyle Lowry have earned a lot of attention and credit for that (rightfully so), but we also have to give credit to Coach Dwane Casey and DeMar DeRozan for helping to get the ball rolling in the first place.
Wisely, the Raptors locked up Nick Nurse to a contract extension this offseason. The next step should be doing the same with Ujiri. The fact that high-profile teams and big markets like the New York Knicks, Brooklyn Nets, L.A. Lakers, and L.A. Clippers all have power brokers in place should be seen as a positive there. There aren't many franchises that in a position to throw $10M+ his way. Still, there's no reason the team should let their magic genie Ujiri go. In a league where role players get $10-15M a year, top executives deserve to get obscenely rich as well. Losing Ujiri would sting badly -- not only for basketball reasons, but also for reputation reasons. The Raptors have had all their wishes come true so far; they can't start pinching pennies now just because it's expensive to varnish a magic lamp.
step two: convince FVV that there is nothing more than this provincial life
It's the dream of every college basketball player to earn the attention and affection of NBA scouts. At Wichita State, Fred VanVleet did his part to turn their eye. He started 100+ games, and helped lead the Shockers to a combined record of 121-24 across four seasons on campus. When he finally strolled into the NBA ballroom... he received nothing but crickets. Eyerolls. Murmurs about his unappealing body. He didn't get drafted at all.
Now, four seasons and one championship later, the league suitors are singing a different tune. It's going to be a weak free agent class, and FVV is one of the Belles of the ball. There's talk that he can generate $15M, $18M, $20M! in salary per season. Heck, I've even heard some talk like 4 years, $100M (that's $25M per year, if you're no bookworm like Belle.)
Ironically, it's some of the same qualities that made NBA scouts dismiss him that make FVV an appealing target now. He's shorter and stubbier, but that strength allows him to play and defend both PG and SG. In fact, basketball-reference charted him as playing 56% of his minutes at SG this season. VanVleet's shooting prowess (39.3% from three for his career) also fits like a glove in the modern NBA. He can be a lead guard, or he can be a complementary 3+D spacing guard... he can do a variety of things to win a team win. As such, he's a "high floor" and "high character" acquisition that can justify an inflated salary, a la Malcolm Brogdon last year (who got 4 years, $85M total from Indiana.)
VanVleet would be a valuable addition to any team, but he's especially valuable to this particular Toronto team. He's already shown that he can play alongside Kyle Lowry, but he may have an even larger role in the future. Lowry's massive contract ($30M per year) is coming off the books after next year. As good as Lowry has been, he's 34 now, and he's not going to be a viable starter forever. VanVleet can continue to play in tandem with Lowry now, and then potentially take the reins of the lead guard position for the next 5 years after. Through that lens, $20M doesn't sound unreasonable at all. I also like the idea of retaining some members of the title team as long as possible, as it adds prestige to the franchise.
No doubt, the Raps will want VanVleet back, even if he's paid $20M per season. He may be worth that. The question is: what happens if he gets offered more than he's worth? What if the Knicks get crazy and offer him $25M or more?
Toronto can't get into an unreasonable bidding war, but they can evoke VanVleet's emotional connection to the franchise and fan base. They helped give him the development and opportunity to become a star. And while Toronto isn't a traditional "big market" compared to New York City, it may be more appealing. Toronto’s a thriving city, where $20 (or $20M) goes a lot further than NYC. Moreover, VanVleet will be a beloved member of the Raptors' franchise and their legacy. If he goes off to be a hired gun somewhere else, those new fans may turn on him as soon as his shooting slumps. If Toronto is effectively "The Beast" (that you learned to love), the Knicks may be "Gaston," the showy rival that you'll only end up resenting. I truly believe that VanVleet is better off in Toronto (even at 80-90% of the price) than going to a franchise like the Knicks. Of course, it's not my decision to make.
step three: Jack and the (singular) Beanstalk
Presuming that Toronto is able to come up with a new accord with Fred VanVleet, they'll have limited coins left in the purse. They may need to make a decision regarding their bigs, with both Marc Gasol and Serge Ibaka entering free agency as well. These are two decorated veterans who have gotten used to gold (this season, Gasol made $25.5M and Ibaka made $23M.)
While the Raptors' frontcourt depth helped them win a title, it doesn't make sense to double dip and OVERLOAD on the position. The modern NBA doesn't cater to centers, so you don't want to tilt your salary cap too much in that direction. Moreover, backup Chris Boucher (also a free agent) deserves some more playing time. It's very realistic for the team to pick one of their current bigs, and roll with Boucher as a backup.
Between the two bigs, I'd lean to retaining Serge Ibaka over Marc Gasol myself. As always, Gasol's raw stats -- 7.5 points and 6.3 rebounds -- don't reflect his actual value. He's a good, heady basketball player who is able to stretch the court offensively. Even at age 35, he's still a good defensive presence. In fact, ESPN's RPM metric graded him as a +3.4 impact per 100 possessions on defense, 5th best among all centers. Still, it's hard to ignore the age factor. Gasol's 35 now, and turning 36 in January. Based on either the eye test or analytics, you can see some decline in his play. Retaining him on a 1-year deal would make sense, but anything more than that would be risky.
Meanwhile, Serge Ibaka is no spring chicken himself. He's listed at 31 (and some think he may be older than that.) Still, he doesn't appear to be in as noticeable of a decline. He still has some spring to his legs, which aids him as a rim protector and also helps him convert inside on offense. He actually outpaced Gasol this year in terms of true shooting percentage 58% to 55%. Overall, Gasol vs. Ibaka is fairly even right now, but we'd have to lean in favor of the younger player as we project to the future. All things (and contracts) being equal, I'd re-sign Serge Ibaka. If Gasol wants to undercut Ibaka and come in for a cheaper deal, then that's a legitimate option as well. Center is less of a priority for all teams right now, and the Raps shouldn't overpay for competent play down low.
step four: dream of a date with Prince Charming, but settle for Prince Charming-Enough
The Toronto Raptors and their fans have their eyes on the prize: Giannis Antetokounmpo. The Greek Freak may hit free agency in 2021, at which point the Raptors could be a legitimate contender for his services.
Realistically, it's hard to imagine the team clearing enough space to sign Antetokounmpo outright. They'd have the room if they didn't re-sign Fred VanVleet or Serge Ibaka to long-term deals, but if they did that, why would Antetokounmpo want to come play for them? He's not leaving Milwaukee unless he signs up with a superior roster.
More likely, Toronto would need to work out some sign and trade centered on Pascal Siakam (and his $30M salary.) If the Raptors had the chance to grab Antetokounmpo, they wouldn't mind waving their diamond in the rough Siakam goodbye. There's some duplication to their talents and skill sets, only Antetokounmpo is a much better version of it. He's also about a year younger. With a Siakam to Antetokounmpo upgrade, the Raps would be right back in the title picture again.
While this whole entry has been about fairy tales, let's take a step back and presume that doesn't happen. What then...?
The first step would be trying to put Siakam in better situations to score. He had been incredibly efficient as a secondary option behind Kawhi Leonard, crashing in the paint and shooting 60.2% from two-point range. This past season, as the go-to scorer, he found those shots harder to come by and saw his two-point percentage plummet down to 49.9%. As a result, his true shooting numbers crashed from 62.8% to 55.4%. Some of that is injury related, but a lot of it is shot distribution and defensive attention. Simply put, Siakam had to work a lot harder to get his points. The prior season, 49% of his twos and 98% of his threes were assisted. This year, those numbers dropped to 42% and 66% respectively. He also took longer threes. In 2018-19, 68% of his three pointers came in the corner. This year, that dropped to 22%. (All numbers courtesy of basketball-reference.)
Overall, the Raptors may need to rethink their usage of Siakam and have him take a step back as a lead option. While the team was still successful overall, their offense wasn't any great shakes, ranking 14th overall. That has to improve if they want to win the East again. One way to potentially do that is to redistribute the scoring wealth. Rather than treating Siakam as a top option, treat him as an option. He's a solid scorer and ball mover -- like most of his teammates -- so let's get them all involved equally. The Raptors goal should be to have their top 6 players (Siakam, Lowry, FVV, O.G. Anunoby, Ibaka/Gasol, and Norman Powell) all average around 15 points per game. They can also get more from rising players like Chris Boucher, Terence Davis, and Matt Thomas (a better marksman than Snow White's Huntsman). With balanced scoring like that from all over the roster, they may be able to get their offense back into the top 10. Better still, they may spin a whole new fairy tale for the Canadian kids to enjoy.

2020.09.26 01:00 Incognico UDM - DOA - Experience so far... READ BEFORE YOU BUY ONE!

I will start off by saying I should probably wait to post this because I am working on no sleep from a very busy work week and I am ready to shut things down and go off line for the weekend... This shouldn't be a problem because I don't have a working UDM anyways... (funny/not funny)
I have seen a thread on here that confirmed that a few people have been having issues with these UDM units. They literally had the same issues I had... It could not complete the setup and it prompted me to "factory reset UDM" every time. Link below.
I really wish I would have seen the post prior to ordering mine! But even if I would have seen it Ubiquiti ended up paying for the shipping of their DOA unit back to Utah sending them a shipping label.
The post I'm referring to was from two months ago and it seems that Ubiquiti has not changed a thing on their return policy for DOA units. I am having the identical issue that they had! I spent three hours trying to get it up and running with new firmware updates and recovery factory resets and tried to set it up on PC and through the APP.

Finally, after being "approved" for an RMA, I come to find out that I have to cover the shipping costs internationally to Utah. I live Just East of Toronto Canada and the original order shipped from Brampton Ontario, which is about 1.5 hours from my place... so I am not sure why they can't take it in if they are the dealer and this is a known issue.
From what I have heard, a friend got their UDM up an running in no time and it's apparently a pretty decent unit. But for those that have had issues, it's not worth the hassle trying to get the unit exchanged under warranty. The thing that most businesses seem to forget is that their customers time is worth something as well.
One thing I did come across in another post somewhere was where people were asking if they should order this through Amazon or through the Ubiquiti Networks store... well either way you are buying it from Ubiquiti or a third party seller, so you better hope that you get a good functioning unit from the start... otherwise you will have to go though the same painstaking process and in the end you will get stuck with the shipping bill to have the unit returned.
All I wanted was a good customer experience and I am literally writing this after I sent [[email protected]](mailto:[email protected]) an email explaining how I don't feel that a customer who bought a brand new unit from their store should have to incur additional fees to have a DOA unit sent back for an exchange/warranty.
Please do your research before purchasing anything! There are other options out on the market that have established themselves with great products, good customer support and multiple vendors that will take their products back or exchange it under warranty right there on the spot.
Who knows, maybe there will be a happy ending to this story... only time will tell. However in the mean time, I can't recommend this product to anyone...

EDIT; UPDATE 9/28/2020
So the first tech support guy reached out to me and asked me to install the UDM Pro firmware update. I kindly let him know that I don't have the pro unit, but if they insist on me doing that, I would.
I get this reply back;
" Yes, that was an update for Pro but can be done on UDM, but that will not be a stable version for UDM.So please upgrade it only if you wish too.

I have done all of the UDM site recommended troubleshooting and sent them all the info and the pics necessary, but why would anyone recommend something that would be unstable?!?!? I am really starting to have doubts on this company and product! of course after that comment I will NOT be updating the firmware with a unstable version. I just want a working unit or my money back at this point!
Really starting to get irate!.. if I handled my customers like this, I would lose them all!...

Well, the DOA UDM is now at their facility and the promise of having an advanced replacement shipped never happened. I am now without any product (working or not) and I can honestly tell you that I would never buy anything form them again. This has to be the worst customer service I have ever experienced!
Their last email to me dated 09/30/2020;

TLDR: bought a UDM and it was DOA. Did all of the troubleshooting and the unit was not working. Hard time to get an RMA and I was expected to pay international shipping to return the unit. They finally sent Shipping labels and said they would arrange to send out an advanced replacement unit. The DOA unit has been shipped back (same day as I received the return shipping labels) and has arrived at their facility 8 days later. Still waiting on confirmation that the replacement shipped. Still can't recommend a product that I don't have... buyer beware.

On June 1, you shared a letter on Reddit’s blog “Remember the Human – Black Lives Matter”. In this letter, you claim “as Snoos, we do not tolerate hate, racism, and violence, and while we have work to do to fight these on our platform, our values are clear.”
As of today, neither you nor any other Reddit admins have shared this letter anywhere on reddit.com. However, the response to this message was swift on Twitter, where you were rightfully labeled as hypocritical based on your long and well-recorded history of defending racism and white supremacy on this site.
Among the many responses was this message from former CEO of Reddit, Ellen Pao.
I am obligated to call you out: You should have shut down the_donald instead of amplifying it and its hate, racism, and violence. So much of what is happening now lies at your feet. You don't get to say BLM when reddit nurtures and monetizes white supremacy and hate all day long
Many others shared links and screenshots of your past statements saying “Open racism and slurs are fine to post on Reddit”.
The problem of Reddit’s leadership supporting and providing a platform for racist users and hateful communities has long been an issue. Nearly six years ago, dozens of subreddits signed the original open letter to the Reddit admins calling for action. While the Reddit admins acknowledged the letter and said it was a high priority to address this issue, extremely little has been done in the intervening years.
On June 5, you shared this update on /Announcements, Upcoming changes to our content policy, our board, and where we’re going from here. In the post, you stated that there is a need for continued adjustments of Reddit’s content policy to address racism and that this remains a priority. These continued statements that you hear us, that this is a priority, or that you are working on it are not enough. It has been five years since your return as CEO and this still remains Reddit’s most glaring problem.

Reddit needs more community managers to build positive relations and engagement with the site’s volunteer moderators.

Alexis requested that his position be filled with a black candidate and we ask Reddit to honor that request. While you have stated your intent to honor that request, we are asking for an announcement to be made on this decision in the next 3 months. We believe this is not an issue that should be put off for action years down the road.
